Consul "to use his good "offices" is a very different thing from "the exercise of diplomatic pressure", and is not expected to be as effective.

At present however the Governor does not discri- -minate between deserving and undeserving cases: the Registrar-Ceneral has received no instructions to report on any other point than the credibility of the evidence of birth, and it is desirable in the first instance, and with- -out regard to any other consideration, for the Governor so to exercise the discretion which he is apparently authorised (though this is by no means clear) to use, such a way as to confine the issue of these certificates
solely to individuals in the class which Sir Henry Blake
had in his mind.

5. The exercise of a discretionary power was in the minds of both the officers who advocated the protection of Chinese in Class 3 and it is improbable that the change
would have been recommended without some security that the
protection should not be abused.
6. The history of the abandonment of the discretion-
-ary power is interesting reading.
Sir Henry Blake desired that discretionary power
should be vested in the Governor or in British Consuls in
China. Sir Ernest Satow very rightly objected to conferring this power on His Majesty's Consuls. The Foreign Office went further, and thought that the exercise of discretion- -ary power by the Governor might possibly lead to differ- -ential treatment of persons within the same category, and suggested the issue of definite instructions to the Colonial Governors. To meet the view of the Foreign Office, the Colonial Office sugested that certificates should only be issued to persons who had resided in the Colony for the three preceding years.
